Mediation

Mediation is one of the fastest, fairest, and lowest costs means of resolving a dispute.  If you want to schedule a mediation, our process is simple:  All you have to do to complete our Schedule A Mediation form; then, we will send you an electronic invoice to pay the initial fees and deposit.  Next, we schedule your mediation with one of our experienced mediators.

Arbitration

If your contract requires the arbitration of disputes, then beginning the process is very easy.  You only need to submit the Make a Demand for Arbitration Form on our website and pay the fees.  If arbitration is not compelled by a contract, then all of the parties involved in a dispute must agree to use arbitration.  After everyone agrees to use an arbitrator, then submit the Make a Demand for Arbitration Form, and then pay your fees.  We will then schedule your arbitration.

Small Claims

We strive to offer fairness and justice to everyone despite the size of the claim, thus we offer “small claim” dispute resolution for a lower set fee so there are no surprises.  To start a small claim mediation, please complete and submit our Schedule a Mediation form; then, we will send you a invoice for the fees and, upon payment, we will schedule your mediation.  If you wish to resolve your legal dispute via arbitration, then you need to submit the Make a Demand for Arbitration form, and we will take it from there.  Please remember that if the parties are not required to pursue arbitration via their contract, then, prior to submitting the form, everyone involved in the dispute must agree to use arbitration as their remedy.

After you decide to let the neutrals at Georgia Center for Arbitration & Mediation assist you in resolving your dispute, then there are a few items which we need to more further along in the process.

First, there is the payment of the fees.  After you submit your form to request mediation or demand arbitration, then we will send you an electronic invoice to process your fees.  We will also send you our standard Arbitration Agreement or our Mediation Agreement which must be signed by all of the parties involved in the mediation.

After the agreement and the payment have been received by us, then we will schedule your initial mediation or arbitration session.  If you selected a particular mediator or arbitrator, then that neutral will offer options for the initial session.  Each neutral works differently.  Some, will have a preliminary telephone or virtual meeting to discuss the schedule and the procedural rules; others, may handle these aspects through email.  Arbitration almost always requires some advance discussions regarding the issues, evidence, procedure, and related matters.
